According to this Act, the term “farm business tenancy” is used to describe any type of tenancy that satisfies the business conditions, as well as one or both of the agriculture conditions or notice provisions.

If at least some of the tenanted land is farmed during the life of the tenancy, the tenancy is called a Farm Business Tenancy. There must also be one of these two things:

  • If the tenancy is mostly agricultural at first, the landlord and tenant can send each other notices before the tenancy starts that say they want it to be a Farm Business Tenancy for the whole time. This lets tenants move away from agriculture if the terms of their tenancy agreement allow this.
  • If the landlord and tenant don’t send each other notices before the tenancy starts, the tenancy business must be mostly agricultural for it to be called a farm Business Tenancy.

Farm Business Tenancy rent reviews

Rental prices can be set by both landlords and tenants. They can also decide if they want to have rent reviews. By law, people can ask for rent to be changed every three years.

The law says that rent should be reviewed every three years. However, landlords and tenants can agree on when this should happen. This means that they can do away with the law. Suppose you agree to a rent review every four years.

Your rent review agreement must not say that you can’t cut the amount of rent you pay.

Agricultural business tenants get money at the end of their lease for things like:

  • physical changes you’ve made to a holding (provided the landlord has given consent to the improvements)
  • changes that make the value of the holdings go up (provided they are left behind when the tenant leaves)
  • You can set a limit on how much compensation you can get from the tenant, which is usually equal to the cost the tenant paid to make the improvements. You can do this in writing.

People who live in agricultural tenancies are people who live on land. A full agricultural tenancy is also called a “holdings act tenancy.” and a farm business tenancy  

They also usually get money at the end of their lease for any long-term improvements they made, their “tenant-right,” and short-term improvements, like using a special farming method that has helped the farm. This amount of money is based on how much the value of the farm has changed because of these improvements.

It’s possible for Landlords to get money from AHA tenants who don’t keep their homes in good condition, like not fixing the farmhouse in line with their rental agreement. At the end of the tenancy, there is a balancing act to be done. The compensation for improvements is often less than the compensation for damages, so there is a trade-off.

In some cases, the original tenants’ grandchildren may be able to keep the family farming business going after they die.

Farm business tenancies

Most tenancies that were signed after September 1, 1995, are subject to the Agricultural Tenancies Act 1995. These are called farm business tenancies. All of them have more leeway to come up with a deal that works for them. The requirements of an agricultural business tenancy are:

  • As long as you live on the land, at least some of it must be used for farming.
  • The landlord and tenant must have sent each other notices before the tenancy starts that show that they want the tenancy to be a ranch business tenancy for the whole time.
  • The land must be mostly used for farming.

The landlord and the tenant can agree on things like how much they pay and how long they stay in the house, as long as these don’t stop them from getting a lower rent. There is no minimum length of time for the tenancy. A tenancy of more than two years will only end when a written notice to quit is served, which must give at least 12 months’ notice.

They can also get money for physical improvements they make to the farm, with the landlord’s permission. This is called a “Farm Business” lease. As long as modifications made by the tenant have been left behind or the value of those improvements has been passed to the landlord at the end of the tenancy period, tenants may be entitled to compensation for such additions.
